These general terms and conditions of sale apply to orders placed by customers on the LE ROUX® Chocolatier Caramélier® merchant site among the products offered at www.chocolatleroux.com. They must be consulted before proceeding with payment of your order.
These general terms and conditions constitute a distance selling contract defining the rights and obligations of the merchant and the customer within the framework of the sale of the products referenced on the site.
The customer shall place the order in accordance with the instructions given on the site. He/she undertakes to fill in the order form, ensuring that the necessary information is complete and accurate. The customer declares that he/she has the capacity to enter into the present contract, the general conditions of sale of which are set out below, i.e. that he/she is of legal age and not under guardianship or trusteeship. Orders are definitively accepted only after validation of the payment of the sum corresponding to the amount of the order. From the moment of the "acceptance click", the order is considered irrevocable and cannot be challenged. SARL Le Roux® reserves the right to refuse an order in the event of the customer failing to meet his obligations, and more generally to refuse all orders of an abnormal nature for any reason whatsoever. The order is definitive only after confirmation by SARL Le Roux® by e-mail.
The goods presented on the site of the store cannot be the subject of request of modification in their composition or their presentation. The texts and photographs illustrating the products are not contractually binding. All photographs and objects in this catalog are only suggestions for presentation.
The price (in euros Net) applicable to the products ordered is that shown on the present site on the day the order is placed. Shipping and delivery costs, which vary according to weight and destination, are extra. Payments can be made by secure credit card: once you have clicked on the card of your choice, you will enter the highly secure virtual domain of the BNP PARIBAS Mercanet bank. Everything will proceed as if you were paying in our store. For security reasons, a photocopy of your bank card may be required. Payments can also be made by cheque made out to SARL LE ROUX or by bank transfer. Your order will be dispatched on receipt of your cheque or bank transfer.
Orders are dispatched within 4 days in France, except in December when delivery times are longer. Shipments are made from Tuesday to Thursday inclusive: our perishable products do not circulate at weekends. Our shipments are made in Normal or Express mode. As Le Roux Chocolatier Caramélier® is a traditional business, delivery times are longer during the festive season, so please place your orders: For Christmas, by December 10th at the latest, For January 1st, by December 20th at the latest. In the event of damage or shortage, it is the responsibility of the consignee to make all necessary reservations with the carrier upon receipt of the goods, and to confirm these reservations by registered letter with acknowledgement of receipt within two days of receipt of the goods.
The 14-day cooling-off period does not apply to perishable products. No returns, refunds or replacements will be accepted. No reservations may be made by the customer concerning the taste, freshness and appearance of the products.
In accordance with articles 26 and 27 of the French Data Protection Act n°78-17 of January 6, 1978, the information requested from the customer is required to process the order and is intended for SARL LE ROUX®. The customer has the right to access information concerning him/her. Upon request, this information may be communicated to the customer and, in the event of error or modification, rectified.
All orders are for personal use only. The resale, use or transformation of our products for any commercial purpose is strictly forbidden without our authorization.
The present general terms and conditions constitute the entirety of the rights and obligations of the parties, and no other conditions may be incorporated into them. In the event of any dispute arising between the parties concerning the formation, performance or interpretation of the present contract, and in the absence of prior amicable settlement, the Lorient courts shall have sole jurisdiction.
By connecting to the SARL Le Roux® website, which holds a user licence and a property right to the graphic elements, the customer agrees not to copy or download all or part of its content, except with the prior and express authorisation of SARL Le Roux®.
